1. Purpose and Scope of Service
WACure, developed by Mayfair Laboratories, provides a WhatsApp-based communication platform designed to facilitate secure interactions between patients and their GP surgeries. Services available through WACure include appointment scheduling, prescription requests, referrals, test result communication, and other non-emergency healthcare inquiries. WACure is an adjunctive tool and is not intended to replace in-person consultations, direct medical treatment, or professional healthcare advice.
2. Not a Substitute for Professional Medical Advice
Content, communications, and information provided by WACure are solely for informational purposes. WACure does not provide medical diagnoses, treatment, or professional healthcare advice. Users are advised to consult a qualified healthcare provider for any medical concerns, especially regarding serious or emergency medical issues. WACure is not intended for use in urgent or emergency situations, and Mayfair Laboratories bears no liability for delays in response or for advice that may be misinterpreted or incorrectly applied.
3. User Responsibility
Users of WACure are responsible for ensuring the security and confidentiality of their communications. This includes taking reasonable steps to secure access to their personal devices, such as enabling device locks or other authentication methods. Users are responsible for any actions taken by third parties with access to their account and for safeguarding sensitive medical information shared through WACure.
4. Healthcare Provider Responsibilities
Healthcare providers using WACure must ensure compliance with their professional responsibilities, local regulations, and patient confidentiality standards. Providers should not rely exclusively on WACure for any critical or time-sensitive healthcare matters. It is the healthcare provider’s responsibility to verify patient identity, confirm all clinical information independently, and ensure that WACure is used only as an auxiliary communication tool.
5. Data Privacy and Security
WACure complies with data protection laws, including the UK GDPR, ensuring that all patient data is managed with confidentiality and in accordance with applicable regulations. Mayfair Laboratories employs appropriate technical and organisational measures to protect user data. However, as with all digital platforms, no communication over WhatsApp can be guaranteed to be entirely secure. By using WACure, users acknowledge that they are aware of the risks associated with digital communications and accept them.
6. Information Accuracy and Reliability
While WACure aims to provide accurate and timely information, Mayfair Laboratories makes no warranties or guarantees regarding the completeness, accuracy, reliability, or suitability of the information delivered. Mayfair Laboratories does not endorse or assume responsibility for the content and advice provided by healthcare providers using the WACure platform. Users are encouraged to verify any medical advice with their healthcare provider.
7. Use of Meta’s WhatsApp Platform
WACure is delivered through the WhatsApp platform, a service of Meta Platforms, Inc. The WhatsApp infrastructure is the bearer of all messages facilitated by WACure, and as such, any issues, malfunctions, delays, or security breaches directly caused by the WhatsApp platform or related Meta services are the responsibility of Meta Platforms, Inc. Mayfair Laboratories bears no liability for any issues arising from the technical operations, limitations, or security of the WhatsApp platform.
8. Integration of Surgery Data
WACure integrates and manages data provided by GP surgeries and makes every reasonable effort to secure this data on registered servers maintained by reputable infrastructure providers. Despite these efforts, Mayfair Laboratories cannot guarantee absolute data security. In the event of any data leakage, breach, or unauthorised access, liability rests between the GP surgery and the hosting provider. Mayfair Laboratories is not responsible for any damages arising from such incidents and encourages all parties to review their security agreements with infrastructure providers.
9. Third-Party Services and Links
WACure may provide links to third-party websites or services as a convenience to users. Mayfair Laboratories does not endorse these third-party services and bears no responsibility for their content, accuracy, or security. Users are encouraged to review the terms and policies of any third-party services they choose to use.
10. Limitation of Liability
To the fullest extent permitted by law, Mayfair Laboratories, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to reputation, arising from or related to the use or misuse of WACure. This includes but is not limited to any errors, delays, interruptions, or vulnerabilities inherent in WhatsApp-based communications. This limitation also applies to any issues arising from the technical infrastructure of WhatsApp or its owner, Meta Platforms, Inc.
11. Indemnification
By using WACure, users agree to indemnify and hold harmless Mayfair Laboratories and its affiliates from and against all claims, liabilities, damages, losses, or expenses (including legal fees) arising from their use of WACure, violation of these terms, or infringement of any intellectual property or other rights of any third party.
12. Amendments
Mayfair Laboratories reserves the right to update or modify this disclaimer at any time. Users are encouraged to review this disclaimer periodically for any updates. Continued use of WACure constitutes acceptance of any amended terms.
13. Governing Law
This disclaimer and any disputes arising from or in connection with WACure shall be governed by the laws of the United Kingdom, without regard to its conflict of law principles. Any legal actions arising from this disclaimer shall be brought exclusively in the courts of the United Kingdom.
